Welcome to Tessie Theater! These Terms of Service ("Terms") govern your access to and use of the Tessie Theater web app available at https://app.tessietheater.com (the "App") and the marketing website at https://tessietheater.com (the "Website") (collectively, the "Services"). The Services are operated by Tessie Theater, LLC, a company based in the United States ("Tessie Theater," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To access the App, you must create an account using Supabase authentication. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@tessietheater.com if you suspect any unauthorized use of your account.

3. Subscription and Payment

Tessie Theater offers a lifetime subscription for $49.99, with monthly ($0.99/month) and annual ($9.99/year) subscription tiers coming soon. All payments are processed securely through Stripe, a third-party payment processor. By subscribing, you authorize Stripe to charge the applicable fees to your chosen payment method, plus any applicable taxes. Subscriptions are non-refundable except as required by law or as specified in Section 9 (Termination).

  • Lifetime Subscription: A one-time payment of $49.99 grants permanent access to the Services, subject to these Terms.
  • Future Tiers: Monthly and annual tiers, when available, will auto-renew unless canceled at least 24 hours before the renewal date. You can manage your subscription through your account settings.

4. Use of the Services

Tessie Theater provides streaming, gaming, and music hubs for Tesla owners to enhance downtime during parked scenarios, such as Supercharger sessions. You agree to use the Services only for lawful purposes and in accordance with these Terms. Specifically:

  • Intended Use: The Services are designed for use while your Tesla vehicle is parked (e.g., during charging or waiting). Do not use the Services while driving, as this may violate local laws and pose safety risks.
  • Prohibited Actions: You may not:
    • Use the Services in any way that violates applicable laws or regulations.
    • Attempt to reverse-engineer, decompile, or hack the App or its underlying technologies (e.g., React, Supabase, Stripe).
    • Share your account credentials with others or allow unauthorized access to your account.
    • Use the Services to distribute harmful content, including malware, viruses, or illegal material.

5. Intellectual Property

The Services, including all content, features, and functionality (e.g., design, icons via Lucide React, code built with React and TypeScript), are owned by Tessie Theater, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, or create derivative works from the Services without our prior written consent.

6. Third-Party Services and Content

Tessie Theater integrates with third-party streaming services (e.g., Netflix, Hulu, Spotify) to provide entertainment. These services are subject to their own terms and privacy policies, which you must comply with. We are not responsible for the availability, content, or performance of third-party services, and your use of them is at your own risk.

  • Stripe Payments: Payments are processed via Stripe. By subscribing, you agree to Stripe’s terms of service (available at https://stripe.com/legal).
  • Supabase Authentication: Account authentication is managed via Supabase. You agree to Supabase’s terms (available at https://supabase.com/terms).

7. Privacy

Your privacy is important to us. Our Privacy Policy (available at https://tessietheater.com/terms-conditions) explains how we collect, use, and protect your personal information, including data processed through Supabase (e.g., authentication) and Stripe (e.g., payment details). By using the Services, you consent to our data practices as outlined in the Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law, Tessie Theater, LLC and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Services. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid for your subscription (e.g., $49.99 for a lifetime subscription).

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Indemnification

You agree to indemnify and hold harmless Tessie Theater, LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights (e.g., intellectual property or privacy rights).

10. Termination

You may terminate your account at any time by contacting us at support@tessietheater.com. We reserve the right to suspend or terminate your access to the Services at our discretion, with or without notice, if you violate these Terms or for any other reason, including but not limited to non-payment or suspected fraudulent activity. Upon termination, your lifetime subscription will not be refunded unless required by law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association (AAA). You waive your right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will notify you of material changes by posting the updated Terms on the Website or App at least 24 hours before they take effect. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes.
